Klarity's Terms of service

Welcome to the Klarity platform (the “Service”) which is provided to you by Klarity AB, company registration number 559057-1724 having its registered address at Birger Jarlsgatan 57C, 113 56, Stockholm, Sweden (“we” or “us”). Your use of the Service provided at klarity.org (the “Webpage”) is regulated by these Terms of Service (the “Terms”). If you do not agree to these Terms, please do not use the Service provided at this Webpage.Persons under the age of 18 may not use the Service.

The Service is a web-based online platform with the purpose of enabling persons who have registered a user account (“Registered Users”) to upload User Content (as defined below) with the aim to engage citizens to expose and take action on corruption. By using the Service, Registered Users can review the uploaded User Content and may add comments, share and flag inappropriate content. The uploaded User Content is categorized and is viewable to anyone who accesses the online platform.

In order to use the Service, you will have to create a user account and sign in to your account on the Webpage. The instructions on how to create a user account are set forth on the Webpage.You may choose a username and a password to sign in to your user account on the Webpage. If you choose to create a new user account, the username and password which you choose must not be: harmful, abusive, racially or ethnically offensive, sexually explicit, defamatory, infringing any intellectual property right or invasive of personal privacy rights. We have the right to change your username and/or password if they, in our opinion, violate these Terms.When creating your user account, you will be asked to submit certain information about yourself such as: email address. The information will be used to provide the Service to you. Your email address will not be visible to other users on the Webpage.If you create your user account using social login such as Google or Facebook, Klarity will receive and store more personal information by default such as your first name, last name, profile picture and gender.When creating a user account on the Webpage, you agree to comply with these Terms. You also approve our processing of your personal data, which is made in accordance with our Privacy Policy (available here klarity.org/privacy-policy).Your account is personal and you are not allowed to transfer your account to any third party. If you have reason to believe that any third party has gained access to your user account, you must immediately inform us. We have the right, but not the obligation, to suspend access to your user account on the Webpage if we have reason to believe that any third party has gained unlawful access to your user account.

You may upload videos, audio clips, written comments, data, text, photographs, software, scripts, graphics and other information ("User Content") to the Webpage. You are fully responsible for any User Content that you upload to the Webpage.You agree and warrant that you will not publish, post, transfer, distribute or upload any content or information to the Webpage and/or the Service which:1is false, misleading, untruthful or inaccurate,2promotes or encourages illegal activity,3is racially or ethnically offensive and/or constitutes agitation against a minority (such as a national or ethnic group),4constitutes defamation, contains pornography or is in any other way sexually explicit,5attacks sexual orientation or religion or is discriminating in any other way, or6is in any way harmful, abusive, offensive or illegal or which infringes the rights of any third party (such as including but not limited to copyright and trademarks).You agree and warrant that you will not, and will not permit any third party to:1use the Webpage and/or the Services to transfer or upload files or other content that contains viruses, Trojans, corrupted data, malicious software or other programs that may harm computers or other property,2use the Webpage and/or the Services to defame, harass, discriminate or threaten another person or in any other way violate the rights of another person,3distribute or reproduce all or any part of the Webpage and/or the Services,4alter, disassemble, decompile or reverse engineer any part of the Webpage and/or the Services, unless explicitly permitted by mandatory law,5use software that reads data on the Webpage and/or the Services automatically,6use the Webpage and/or the Services to request or encourage other users to breach any provision of these Terms of Service,7abuse the Webpage and/or the Services or use it for any unlawful or unauthorized purpose (which includes transmitting any computer viruses through the Webpage, or8using the Webpage and/or the Services in a manner which violates or infringes the rights of anyone else).The Service may enable you to send messages to other users. You are personally responsible for any messages that you send by using the Service and you warrant that you will not send messages in breach of these Terms, including to harass or threaten other users.If you receive any messages or see any User Content that you think are in breach of these Terms, or otherwise believe that the Webpage and/or the Service are used for illegal purposes or for purposes which are not in accordance with these Terms, please contact us at info@klarity.org.In the event that a Registered User reveals information regarding its identity to you, you undertake not to reveal, disclose, publish or otherwise share any information regarding the identity of such Registered User to any other person whether registered as a user of the Service or not unless the Registered User has given their expressed permission.We reserve the right to immediately remove any content from the Webpage that we in our sole discretion deem is illegal, in breach of these Terms, any other terms or policies posted on the Webpage or is otherwise harmful to us or to our users.

The Webpage and the Service are provided ‘as is’ without warranty of any kind and your use of the Service is solely your responsibility. We do not grant any warranties, express or implied or otherwise, as to the accessibility, quality, fitness for any particular purpose, suitability or accuracy of the Webpage or the Service. We advise you not to trust the accuracy of the Service and expressly disclaim all liability regarding the functionality of the Service.There may be situations when the Service will not be accessible, including but not limited to necessary maintenance and circumstances outside our control, for which we shall never be liable.

We process personal data received in connection with the use of the Service. The personal data processing is made in accordance with our Privacy Policy (available here klarity.org/privacy-policy).

You agree that the Webpage and the Service contains content specifically provided by us or third parties and that such content may contain intellectual property rights.You agree to respect all intellectual property rights, including but not limited to copyright, trademarks, trade names (whether registered or not) contained or displayed on the Webpage or which you gain access to in connection with the Service.You may only use the content of the Webpage for your own use of the Service and you must not use the content of the Webpage in breach of applicable law or these Terms of Service. You may use such content only for the purpose of using the Service.We do not grant you any other license to use said intellectual property rights except as expressly set out in these Terms of Service.You agree that the content published on the Webpage may belong to third parties, and that we do not have control over such content. Therefore, you agree that we shall not be held responsible for any such content provided by third parties and displayed on or contained in the Webpage or the Services.

When using the Services you may upload User Content to the Webpage. Ownership of all User Content shall stay with you, or the third party having ownership to such User Content.You hereby grant us a worldwide, non-exclusive, royalty-free and sub-licensable right to host, publish, distribute, stream, transmit, playback, transcode, edit, copy, feature, display and otherwise use the User Content to provide and market the Webpage and the Service.You warrant that you have all necessary rights to display and upload the User Content and in all other ways use the User Content and to provide us with the above license to the User Content. Should any User Content be unlawful, contain unlawful material or infringe the intellectual property rights of a third party, you agree to immediately remove all non-compliant and/or infringing parts of the User Content, as applicable, and indemnify us all damages, costs and expenses incurred as a result of such non-compliance and/or infringement.Should we be made aware or have reason to believe that the User Content is unlawful, contains unlawful material, or infringes any third party's intellectual property rights, we have the right, but not the obligation, to remove from the Webpage all such User Content and may suspend access to your account temporarily or permanently.

You are liable to us for any damages caused to us, or any third party, due to your breach of these Terms, including but not limited to the misuse of the Webpage and/or Service. Furthermore, you agree to indemnify us in relation to any claims, costs (including reasonable legal costs) damages, expenses, liabilities and losses incurred by us arising in any manner in relation to your breach of these Terms.To the extent permitted under mandatory law, we shall not be liable to you or any third party for any direct damages, indirect damages or any other damages of any kind including but not limited to loss of profit, loss of income, loss of revenue, business interruption or goodwill losses arising out of or in connection with these Terms or the use of or inability to use or access the Service or the Webpage. We are not liable to you for any claims made by third parties towards you.

We reserve the right to make changes to these Terms. We will inform you of any such changes at the latest thirty (30) days before a change starts to apply. We will give you such information by clear notice here klarity.org/terms-of-service or by email to the email address provided by you.You have the right to at any time and without prior notice terminate your user account and remove your content from the Webpage.We have the right to suspend your access to the Service with immediate effect if we have reason to believe that you are violating these Terms. Furthermore, we reserve the right at any time to modify, discontinue, temporarily or permanently cease providing the Service without prior notice at any time and at our own discretion, or if required by law or decision by an authority. You agree that we shall not be liable to you or to any third party for such modification, suspension or discontinuance.

You may not transfer or assign any rights or obligations and licenses granted under these Terms. We may transfer and assign these Terms without your consent and without notice to you.

These Terms shall be governed by and construed in accordance with Swedish laws, without regard to its conflict of law rules.Any dispute, controversy or claim arising out of or in connection with these Terms, or the breach, termination or invalidity thereof, shall be finally settled by the Swedish courts, with the District Court of Stockholm as the first instance, unless otherwise provided by mandatory law.
